JOYZAP TERMS OF USE 

1. Services and Scope of the Platform
The "JoyZap" platform offers virtual surprises with the value of real money. It is a social network for holidays and surprises where users can share upcoming events, follow others’ events, and exchange well-wishes.

2. Terms of Use of the Service

The "JoyZap" platform is available only to users who are of legal age (18 years or older). The service is available in countries where the payment processor Stripe offers partnership and cash-out options via Stripe Connect. Users must comply with local laws and the platform’s terms of use, and must verify their age during registration.

3. Rights and Obligations of Users

Users of the "JoyZap" platform are required to provide accurate, truthful, and up-to-date information during registration, including a valid email address, personal phone number, first and last name, and the creation of a secure password. Incorrectly entered information may prevent the service from functioning correctly and may lead to issues with service provision. Users are responsible for the accuracy of the information they provide, and "JoyZap" is not liable for any problems arising from incorrect data submission.

4. Prohibited Behavior

Users of the "JoyZap" platform are prohibited from creating or posting content that includes obscene language, offensive or inappropriate material of a sexual or violent nature. Posting content that promotes violence, racism, discrimination, or is related to illegal activities such as the use of weapons, drugs, terrorism, and similar is prohibited. The platform strongly condemns any behavior that may violate public norms and ethics, including defamation, threats, and harassment.

Users may not use the service for illegal activities, manipulation, or attempts at fraud, nor post content that may harm the platform’s reputation or violate applicable laws.

5. Right to Amend Terms of Use

"JoyZap" reserves the right to change and update these Terms of Use at any time without prior notice. Every user who completes the registration process and starts using the service automatically agrees to the current terms, including any future changes. In case of significant amendments, users will be notified via a message on the platform or through their provided contact details (such as email), but the responsibility for regularly reviewing the updated terms remains with the user.

6. Dispute Resolution and User Rights

In the event of disputes between "JoyZap" and users, the platform reserves the right to make decisions based on its own understanding of the dispute. However, the platform will strive to resolve the dispute in a fair manner and in a way that does not harm either party, and will seek a compromise solution when possible.

If consensus cannot be reached, "JoyZap" reserves the right to terminate service provision for one or both parties in the conflict, without liability for any damages or inconveniences.

7. Intellectual Property

The "JoyZap" platform andall its elements, including but not limited to software, logos, trademarks, graphics, texts, and other materials, are the property of "JoyZap" and are protected by copyright and other intellectual property laws. Users of the platform acknowledge that all rights to the content of the platform belong to "JoyZap" or the respective rights holders.

Users of the platform retain the right to post or share content (such as text, images, videos, and other materials), but by providing such content to the platform, they grant "JoyZap" a non-exclusive, royalty-free, worldwide right to use, reproduce, distribute, modify, adapt, publish, and display that content within the platform or related services, including for advertising purposes. Users also declare that they hold all necessary rights to the content they post and that this content does not infringe the rights of third parties.

"JoyZap" reserves the right to remove or modify content that violates the terms of use or applicable laws.

8. Limitation of Liability

The "JoyZap" platform provides its services on an "as is" and "as available" basis, without any guarantee of error-free or uninterrupted operation. "JoyZap" does not guarantee that the platform will be free from errors, that the service will meet all users' requirements, or that it will be free from viruses or other technological issues. The platform is not responsible for any service interruptions, data loss, or damages arising from the use of the platform.

"JoyZap" is not liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the use or inability to use the platform, including but not limited to loss of profit, reputation, or any other economic loss, unless required by applicable law.

The platform is not responsible for the actions or omissions of third parties, including payment service providers and other external partners, that may affect the operation of the platform.

Users agree that their use of the platform is at their own risk, and "JoyZap" is not liable for any damages, losses, or costs arising from improper use of the service.

9. Compliance with Laws and Tax Obligations

Each user of the "JoyZap" platform is responsible for complying with applicable tax laws regarding their income, including the obligation to pay taxes on any profits received after withdrawing funds from the platform. "JoyZap" is not responsible for users' tax obligations or any disputes arising between users and tax authorities.

Users are obligated to inform themselves of their tax responsibilities and to fulfill them in accordance with applicable laws in their respective jurisdictions.

10. Anti-Money Laundering Policy

JoyZap strictly prohibits the use of our platform for any activities related to money laundering. To ensure compliance with applicable laws and regulations, we may take the following actions:

Verification of Identity: Users may be required to provide valid identification documents to verify their identity and payment information before accessing certain features or withdrawing funds.
